3. Legal Basis for Processing (EEA, UK, and Switzerland Users)
If you are located in the European Economic Area, the United Kingdom, or Switzerland, our
processing of your personal data is based on the following legal grounds:
Performance of a contract: processing necessary to provide the Service you have
requested, including profile creation, employer discovery, and AI video generation.
Legitimate interests: processing for fraud prevention, security, product improvement,
and analytics, where those interests are not overridden by your rights.
Consent: where we rely on your consent, such as for the use of your likeness
in AI-generated videos or for promotional communications. You may withdraw consent at any time
without affecting the lawfulness of prior processing.
Legal obligation: processing required to comply with applicable law.
4. How We Share Your Information
We share your information in the following circumstances:
With Employers, Recruiters, and Viewers
Your profile information, including your name, employment history, skills, photos, videos, and
any other content you choose to make visible, is shared with registered employers, recruiters,
and hiring teams who access the Service to find candidates. The extent of what is shared
depends on your visibility settings. Once an employer or recruiter accesses your profile, we
cannot control how they store, use, or further share that information.
With Service Providers
We share information with third-party vendors and service providers who perform services on
our behalf, including cloud hosting, payment processing, email delivery, analytics, AI model
providers, fraud prevention, and customer support. These providers are contractually required
to protect your information and use it only for the purposes for which it was disclosed.
For Legal Reasons
We may disclose your information if we believe in good faith that disclosure is necessary to:
comply with applicable law or legal process; protect the rights, property, or safety of Flypt,
our users, or others; detect, prevent, or address fraud or security issues; or enforce our
Terms of Service.
Business Transfers
If Flypt is involved in a merger, acquisition, financing, restructuring, bankruptcy, or sale
of all or substantially all of our assets, your information may be transferred as part of that
transaction. We will notify you of any such change in control and any resulting changes to
this Privacy Notice.
Aggregated and De-identified Data
We may share aggregated, de-identified, or anonymized data that cannot reasonably be used to
identify you with third parties for research, analytics, and business purposes.
5. Public Profile Visibility
Flypt is designed to make your profile visible to employers and recruiters. Information you
add to your profile may be indexed by search engines, cached, copied, screenshotted,
downloaded, or otherwise distributed by third parties after they access the Service. Adjusting
your visibility settings limits future access but does not recall information already
accessed, indexed, or distributed.
Do not include in your profile information that you consider sensitive, confidential, or that
you are not authorized to share. Although we provide visibility controls, no technical measure
can fully prevent the further distribution of publicly accessible information.
6. Cookies and Tracking Technologies
We use cookies, web beacons, pixels, and similar tracking technologies to operate the Service,
remember your preferences, analyze usage, prevent fraud, and, where applicable, deliver
relevant content.
Essential cookies: required for the Service to function. Cannot be disabled
without affecting core functionality.
Analytics cookies: help us understand how users interact with the Service so
we can improve it.
Preference cookies: remember your settings and personalization choices.
Marketing cookies: where applicable and with your consent, used to deliver relevant
advertising and measure its effectiveness.
You can manage cookie preferences through your browser settings or through our cookie consent
tool where provided. Note that disabling certain cookies may affect Service functionality. For
more information about our use of cookies, please contact us at privacy@flypt.org.
7. Data Retention
We retain your information for as long as your account is active or as needed to provide the
Service. When you delete your account, we will delete or anonymize your personal information
within a commercially reasonable time, except where we are required or permitted by law to
retain it for longer, including for fraud prevention, dispute resolution, legal compliance,
and enforcement of our Terms of Service.
Backup copies of deleted data may persist for a limited period before being overwritten.
AI-generated videos and outputs created from your profile and already delivered to employers
or shared through the Service may not be retrievable or deletable after delivery.
8. Data Security
We implement commercially reasonable technical and organizational measures to protect your
information against unauthorized access, disclosure, alteration, and destruction. However, no
security system is impenetrable, and we cannot guarantee the absolute security of your
information. You are responsible for maintaining the security of your account credentials.
If we become aware of a security breach that affects your personal information in a manner
that creates a material risk of harm, we will notify you as required by applicable law.
9. Children’s Privacy
The Service is not directed to children under the age of 13, and we do not knowingly collect
personal information from children under 13. If we learn that we have collected personal
information from a child under 13, we will delete it promptly. If you believe we may have
collected information from a child under 13, please contact us at privacy@flypt.org.
10. Your Rights and Choices
Depending on your location and applicable law, you may have the following rights regarding
your personal information:
Access: request a copy of the personal information we hold about you.
Correction: request that we correct inaccurate or incomplete information.
Deletion: request that we delete your personal information, subject to certain
exceptions.
Portability: request a copy of your personal information in a structured, machine-readable
format.
Restriction: request that we restrict processing of your personal information
in certain circumstances.
Objection: object to processing based on legitimate interests or for direct
marketing purposes.
Withdrawal of consent: where processing is based on consent, withdraw consent
at any time.
To exercise any of these rights, please contact us at privacy@flypt.org with your name, email address, and a description of your request. We will respond within the
timeframe required by applicable law. We may need to verify your identity before processing your
request.
We will not discriminate against you for exercising your privacy rights.
11. California Residents — Geographic Restriction
THE SERVICE IS NOT CURRENTLY AVAILABLE TO RESIDENTS OF THE STATE OF CALIFORNIA.
If you are a California resident, you may not create an account or use the Service. By
creating an account, you represent and warrant that you are not a current resident of the
State of California. Flypt reserves the right to block or terminate access to the Service
based on geographic location.
This restriction is temporary while Flypt completes implementation of California Consumer
Privacy Act (CCPA) compliance infrastructure. The CCPA gives California residents specific
legal rights over how their personal data is collected and used, including rights to access,
delete, and correct their data, and the right to opt out of the sale of their personal
information. Flypt intends to implement full CCPA compliance and make the Service available to
California residents in the future. When that occurs, this section will be updated to reflect
the rights available to California residents.
If you are a California resident with questions about this restriction, please contact us at privacy@flypt.org.
12. UK and EEA Residents — Additional Rights (UK GDPR / GDPR)
If you are located in the United Kingdom or European Economic Area, you have rights under UK
GDPR and GDPR as described in Section 10 above. You also have the right to lodge a complaint
with your local supervisory authority:
UK residents: Information Commissioner’s Office (ICO) at ico.org.uk.
EEA residents: the supervisory authority in your country of residence.
Where we transfer your personal data outside the UK or EEA, we use appropriate safeguards,
including standard contractual clauses approved by the relevant authorities, to protect your
data.
13. International Data Transfers
Flypt is operated from the United States. If you are located outside the United States, your
personal information will be transferred to and processed in the United States, where data
protection laws may differ from those in your country. By using the Service, you acknowledge
this transfer. Where required by applicable law, we implement appropriate safeguards for
international transfers.
14. Third-Party Links and Services
The Service may contain links to third-party websites, tools, and services. This Privacy
Notice does not apply to those third-party services, and we are not responsible for their
privacy practices. We encourage you to review the privacy notices of any third-party services
you use.
15. Changes to This Privacy Notice
We may update this Privacy Notice from time to time. When we make material changes, we will
post the updated notice on this page with a new effective date and provide additional notice
where required by law, such as an in-app notification or email. Your continued use of the
Service after changes become effective constitutes your acceptance of the updated Privacy
Notice.
